• Heating Oil Tanks- New Laws

    As of October 1, 2015, North Carolina Laws pertaining to Non-Commercial Home Heating Oil Tanks have changed and the Non-Commercial LPUST Cleanup Funds (aka Trust Fund) have been eliminated. Two primary forces have changed concerning the liabilities associated with leaking oil tanks; which are 1) in most cases a property owner can directly opt to place a land use restriction on a property when a tank has leaked to achieve a No Further Action (NFA) status with the NCDEQ without having to remove any petroleum impact. 2) There is no reimbursement of cleanup costs should a property owner decide to remove petroleum impacted areas to avoid any land use restrictions to the subject property.
